Terms of service

NudgeWin provides quote tracking, automated follow-up scheduling, reply handling and related business workflow tools for trades and service businesses.

NudgeWin is operated by Eric Duplaix.

You must provide accurate account and business information, keep your login credentials secure, and use NudgeWin only for lawful business purposes.

You remain responsible for the quotes, customer details, sender information and message content you enter into the service.

You are responsible for ensuring you have a lawful basis to contact each customer and that your messages identify your business accurately. NudgeWin must not be used with purchased, scraped or unrelated marketing lists.

You must respect replies, unsubscribe requests and other requests to stop contact. Automated follow-ups should only be used for legitimate quote-related communication.

NudgeWin may offer a free trial before a paid subscription begins. Current plan prices and inclusions are shown on the NudgeWin website and may change prospectively.

Paid subscriptions are processed through Stripe. Unless otherwise stated at purchase, subscriptions renew automatically until cancelled. You can manage or cancel an active subscription through the billing portal made available in the service.

Any applicable taxes, statutory guarantees, refund rights or other non-excludable consumer rights continue to apply as required by law.

You must not use NudgeWin to send unlawful, deceptive, abusive or unsolicited messages; interfere with service security; access another workspace without permission; introduce malicious code; or use the service in a way that violates applicable law or a third party's rights.

We aim to keep NudgeWin available and reliable, but uninterrupted or error-free operation cannot be guaranteed. Features may be changed, maintained or temporarily unavailable where reasonably necessary.

NudgeWin does not guarantee that a follow-up will recover revenue, win a job or produce any particular commercial result.

NudgeWin relies on third-party providers including Railway, Resend, Stripe and PostHog. Their availability, security practices and separate terms may affect parts of the service.

To the extent permitted by law, NudgeWin is not responsible for indirect or consequential losses arising from use of the service, customer decisions, failed deliveries or third-party outages.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded under applicable Australian law.

We may update these terms when the service, pricing, legal requirements or operating arrangements change. Material changes will be reflected in the published terms.

We may suspend or terminate access where reasonably necessary for security, non-payment, unlawful use, serious misuse or material breach of these terms.
